BINDING AGREEMENT 

The terms and conditions constitute a valid and binding agreement between Thai Express and rewards program members (“you” or “Member”) regarding its rewards program. By registering your rewards card online, you agree to be bound by these terms and conditions as well as those found at https://my.spendgo.com/index.html#/register/thaiexpressca.

REGISTRATION

You must become a rewards member in order to participate in the Thai Express rewards program. You can become a member by registering your Thai Express rewards card online at https://my.spendgo.com/index.html#/register/thaiexpressca. You must ensure that you have entered your contact information correctly and provided an active email account address.

PROMOTIONS

By providing your contact information, you authorize Thai Express to send you promotional items and other Thai Express rewards-based promotions. These items and promotions may be sent to you via mail, email, or SMS. Thai Express is under no obligation to send you any of the aforesaid items or promotions.

All rewards program benefits and offers are subject to availability and may be changed at any time without notice.

ELIGIBILITY

Membership in the Thai Express rewards program is free and available to any individual who (i) possesses the legal authority to agree to these terms and conditions as well as those established by its partner which may be found at https://my.spendgo.com/index.html#/register/thaiexpressca; (ii) resides in a jurisdiction which legally permits participation in a rewards program and (iii) provides valid and accurate information when registering their card.

POINT ACCUMULATION AND REDEMPTION

Thai Express rewards Members can accumulate points at participating Thai Express locations.

Thai Express rewards points are automatically converted to a $5.00 reward once you accumulate 75 points. The rewards may be used for purchases at participating Thai Express’s restaurants located in Canada. The rewards must be redeemed within the 30-day period following the day on which they are earned. If the rewards are not used within this delay, they automatically expire and can no longer be used.

PROGRAM

The following table contains a summary of the Thai Express rewards program.

 * Less taxes and other exclusions.

** The rewards expire after 30 days.

*** Offer valid 1 week before birthdate and expires 30 days after your birthdate.

TRANSACTION 

In order for a transaction to be considered valid (and allow you to accumulate points), you must enter your contact information at the time you make a purchase.  Points are only accumulated on purchases of $5.00 or more before taxes if they are made at participating Thai Express locations.

NO CASH

The rewards, promotions and offers provided by Thai Express in connection with this program cannot be exchanged for cash.

ACCOUNTS AND ADJUSTMENTS

Your transaction history (complete with rewards you have accumulated) will be preserved if you have registered your card online.

A Member may request points earned in connection with a transaction that is not reflected in their account by contacting Thai Express’ customer service team at rewards@thaiexpress.com. Such request must be received within the 60-day period following the transaction in question. Once Thai Express receives such a request, it will determine whether an adjustment is required. Thai Express has no obligation or duty to correct an error unless the aforesaid request is received within the prescribed delay and the Member has provided any information or document required by Thai Express.

BALANCE

Thai Express rewards members can obtain their account balance by registering their card online at https://my.spendgo.com/index.html#/register/thaiexpressca  or by emailing Thai Express’ customer service department at rewards@thaiexpress.com.

NO SALE OR TRANSFER

Members do not have the right to sell or transfer any points, awards or other Member benefits. Thai Express may refuse to honor or recognize any points, awards or Member benefits which it believes may have been transferred or sold.

PERSONAL INFORMATION

Members are required to notify Thai Express if there is a change in their personal information, such as their address, telephone number and email address. Changes can be made by updating member online profiles.

By opening a rewards account, you consent to the collection, use and disclosure of personal data by Thai Express’ rewards partners.

MODIFICATIONS

Thai Express reserves the right, at its sole and absolute discretion, to modify these Term and Conditions and to select its rewards partners. Modifications to the program will be made directly on the Thai Express website and will not be the subject of any notice. Your continued use of your card (or membership account number assigned to you) will constitute your agreement with any changes made by Thai Express.

TERMINATION

Thai Express reserves the right, at its sole and absolute discretion, to terminate the Thai Express rewards program. If the program is terminated, Thai Express will provide advance notice to all Members and confirm the effective date of termination.

A Member cannot accumulate points or claim rewards after the effective date of termination of the program. If the program is terminated, all unredeemed points will be forfeited without any obligation or liability and no award claims will be honored after the effective date of termination. Thai Express will not compensate or pay cash for any forfeited or unused points or rewards.

Limitation of Liability

To the fullest extent permitted by law, Thai Express shall not be liable for any losses, costs, expenses, fines, fees or damages of whatsoever nature and kind, including, without limitation, direct, indirect, incidental, consequential, punitive, special or exemplary damages (hereinafter collectively referred to as, the “Damages”) arising from or in connection with the rewards program, the whole regardless of whether Thai Express has been advised of the Damages or whether such Damages were reasonably foreseeable.

INTERPRETATION

All interpretations of these terms and conditions are at Thai Express’ sole discretion. All decisions made by Thai Express shall be final.

 GOVERNING LAW

This agreement shall be governed by and construed in accordance with the laws of the Province of Québec and the applicable laws of Canada therein. 

ENTIRE AGREEMENT

This agreement is the complete and exclusive statement of agreement between you, Thai Express and all its affiliates regarding the subject matter hereof and supersedes all prior agreements and understandings in connection therewith.

ENFORCEABILITY

Should a term or condition set forth herein be determined to be unenforceable, that term or condition will be ineffective to the minimum extent necessary so that the remaining terms and conditions will otherwise remain in effect. 

WAIVER

Thai Express’ failure to enforce any provision found in these terms and conditions or its waiver of any breach of these terms and conditions shall not prevent any subsequent enforcement of any such provision or be deemed a waiver of any subsequent breach.

English Language

The parties hereby acknowledge that it is their express wish that these terms and conditions be drawn in the English Language only. Les parties reconnaissent qu’il est de leur volonté expresse que ces Conditions d’utilisation soit rédigées en langue anglaise seulement.
